Questions

About selling a house during a divorce in Lake Norman

Do we have to sell the house?

That is between the two of you, your attorneys and, if it comes to it, the court. It is not ours to answer. What we can tell you is what the house would sell for and net, which is what every one of those conversations needs.

Can we list the house before the divorce is final?

Often, when both owners agree and both sign. How the proceeds are held or divided is a question for the attorneys, and worth settling in writing before the house goes on the market.

We each have a different number for the house. What then?

That is the usual case. One page, with the recent sales shown and the reasoning visible, gives both sides the same thing to read. It does not settle who gets what. It settles what is being divided.

Can one of us just take the other off the deed?

A deed and a mortgage are two different things. Coming off the deed does not release anyone from the loan. Ask your attorney and a lender how the loan gets into one name before agreeing to it.

Will you work with both of us?

Yes. When a jointly owned house is listed, both owners are the client, both sign, and both get the same updates at the same time.
